What is Oregon BPS?

The Oregon Building Performance Standard (Oregon BPS) is a mandatory program that aims to bring awareness about building energy use to owners of existing commercial buildings, and to reduce energy use and utility costs for less efficient buildings.

How to Comply with OR BPS

Building

a structure, including mobile homes, manufactured homes, and other factory-built buildings, wholly or partially enclosed within exterior walls

Building Owner

an individual or entity possessing title to a building. In the event of a land lease, the building owner is the entity possessing title to the building.

Oregon BPS Compliance

If a building is determined to be a Tier 1 or Tier 2 building that must comply with Oregon BPS, various forms must be submitted

Submit all compliance documentation to the Oregon Department of Commerce by your deadline.

Important: Tier Requirements Differ

Tier 1: EMP and O&M must be enacted 12 months before compliance deadline.
Tier 2: Buildings are required to report Energy Use Intensity and Energy Use Intensity Targets by their July 1, 2028, compliance deadline.
Tier 2 buildings have more flexibility in timing but still need comprehensive planning.

Tier 1

The Oregon Building Performance Standard (Oregon BPS) is mandatory for Tier 1 covered buildings located in the state of Oregon.

What is a Tier 1 Building ?

Tier 1 building is a building where Non-Residential Hotel and Motel equals or exceeds 35,000 square feet. including the parking garage area.

Mandatory for Tier 1 Covered Buildings in Oregon:

Tier 1 buildings are required to report Energy Use Intensity and Energy Use Intensity Targets and submit operations & maintenance and energy management plans by their compliance date.

Tier 1 buildings that expect to exceed their energy target must report at least 180 days before their compliance date, perform energy audits and life cycle cost assessments, and develop a plan to implement cost-effective energy efficiency measures by their June 1, 2028/2029/2030, compliance date.

Tier 2

The Oregon Building Performance Standard (Oregon BPS) is mandatory for Tier 2 covered buildings located in the state of Oregon.

What is a Tier 2 Building?

Tier 2 building is a building where Non-Residential Hotel and Motel at least 20,000 and less than 35,000 square feet excluding any parking garage or special gross floor area

Mandatory for Tier 2 Covered Buildings in Oregon:

Tier 2 buildings are required to report Energy Use Intensity and Energy Use Intensity Targets by their July 1, 2028, compliance date

Benchmark:

Tier 2 buildings must benchmark their energy use, so their total annual energy use intensity (energy use per square foot) is calculated and compared to an energy target for buildings with similar activity type.

Special Tier 2

The Oregon Building Performance Standard (Oregon BPS)  is mandatory for Special Tier 2 covered buildings located in the state of Oregon.

What is a Tier 2 Special Building?

Special Tier 2 building is a building where multifamily, hospital, school, university, residential care, and senior care equals or exceeds 35,000 square feet excluding any parking garage area

Mandatory for Tier 2 Special Covered Buildings in Oregon:

Special Tier 2 buildings are required to report Energy Use Intensity and Energy Use Intensity Targets by their July 1, 2028, compliance date

Benchmark:

Special Tier 2 buildings must benchmark their energy use, so their total annual energy use intensity (energy use per square foot) is calculated and compared to an energy target for buildings with similar activity type.
