ASHRAE Level 2 Audits for Oregon Tier 1 Buildings

Commerce offers incentives and grants to building owners who are required to comply with the Oregon Buildings Performance Standard (Oregon BPS). Oregon House Bill 3409 directs the Oregon Department of Energy to establish an early compliance incentive program. $2 million (for round 1, $12M total) in state funding has been allocated to this program to help building owners offset costs associated with compliance, such as energy benchmarking and reporting or performing an energy audit.

Tier 1 and Tier 2 building owners may receive an incentive of up to $0.85 per square foot of gross floor area with caps of $10,000-$50,000 per building based on building type and size. Compliance isn’t optional, it’s a requirement.

When do I need an ASHRAE Level 2 audit?
If your Tier 1 building is expected to exceed EUIt, you must report that at least 180 days before your compliance deadline and complete an ASHRAE Level 2 audit to identify cost-effective efficiency measures.

EUIt is the energy use intensity target set by ODOE for each property type and climate zone. Tier 1 buildings must meet or beat their EUIt by their compliance deadline.

Tier 1 non-compliance penalties are $5,000 plus $1 per square foot per year. Tier 2 has no performance target in the first compliance cycle, so there is no non-compliance penalty during that cycle.
